MIGA is incharge of the DOJ (the guys who are responsible for federal criminal prosecutions), not the judges who would be ruling on this case. Even judges appointed by trump tend to dislike him. The case would trivially get thrown out before even getting to the jury, due to anti-Slapp laws in new york.
The person making these decisions at vice might not know about these details, but there's no statement from them about this yet about why its down.
