Some people might only fantasize about doing certain things but will never act based upon them, but other people are more impulsive and much more likely to commit such things, so if one of the former speaks about such things to other things to such people, they could be counted as intellectual authors of crimes.
No, I don't really believe teenagers are innocent or that they need to be protected. They might do dumb shit that can potentially risk their safety or life, but so can adults. The problem with pedophiles is not so much the fact that they can have sex with minors but rather the fact that they might be doing it with them because it's easier to trick them into having sex.
There's probably a great number of cases where so-called "statutory rape" can count as rape, but there might also be some where everything is perfectly consensual in all senses except legal.
But no, I don't think it's worth trying to convince lawmakers and judges that pedophilia isn't always intrinsicaly linked to rape and I don't think it's a good idea to have sex with pre-pubescent children or even teenagers (mostly because of its social and legal repercussions).
