Look it up yourself but a hot dog place wanted to open in a strip mall that had a non-compete clause with the sandwich shop (believe it was subway) that was already there that said they couldn't let any other sandwich shops open up. The court ruled that the hot dog place wouldn't be competing with the sandwich place because the average consumer didn't see them as the same thing. If you said, 'I'm going out to get a sandwich' and then came back with a hotdog, a reasonable person would think you were stupid.
