It's not about free market, it's about making sure there are suitable incentives for artists and creators to be artistic and creative. But the way the Americans have rewritten IP laws over the past three decades is disgusting.
That said, most of the time it's not even a copyright that's the issue, it's a trade mark. Like most Disneyshit is not actually in copyright, it's just trademarked. There's nothing stopping anyone from making their own Little Mermaid, as long as it doesn't look like a Disney product.
