Now if she is talking about non criminal court then yes, she is partially correct in that the majority of the time you sue someone you will have to pay for your own legal representation. However there are several attorneys and several law firms and non profits that will actually take a case pro bono.
As for the victim not having evidence of a sexual assault. Often times evidence is readily obtainable up to 48 hours after a sexual assault. Some new technologies allow it even farther than that. Rape kit is often the most common evidence sought by law enforcement after a report of a sexual assault.
