If you break into someone's house and kill them you don't get manslaughter because "you only wanted to rob them" same if you kill someone while robbing a bank, or a car jacking like this case. The crime was premeditated and the killing was part of that premeditated crime. Thus it is 1st degree premeditated murder. That's how it works.
