>>14117908In the us there is a difference between criminal law and civil law. Civil law (Not to be confused with the Civil law of some European countries ). In civil law the government is used to mediate a dispute between two parties. In criminal law the government is the party accusing somebody of a crime, and all prosecution happens from the government. Generally, to enforce copyright, the owner of the copyright has to sue the other person creating copies of their works. This would be handled by the civil courts. Since the owner is suing the person, they are in charge of giving evidence to show that the person has in fact infringed their copyright, The government is only there to make a judgement on the evidence provided by both parties. You cannot go to jail due to a civil offense. With criminal copyright infringement, the copyright owner does not to do any of the prosecution (they are not suing you), all prosecution is handled by the government. It is possible to go to jail over criminal offenses.
