>>15209842It would have been more proper for me to say that the bill of rights (plus some of the later amendments) were made to protect rights. The Supreme court is in charge of interpreting the constitution to make sure no law made by congress contradicts a right enumerated by the constitution. It is also supposed to protect some rights not enumerated but are nonetheless present in English common law. The supreme court is undemocratic because it is supposed to enforce the constitution even if a certain provision of it becomes unpopular. The end result of this is that they end up protecting rights even if they are unpopular to protect.
My main point I was trying to make is that the Supreme Court was undemocratic because a democratic court would do a poor job of protecting unpopular rights. Which are given to us by the constitution.
