>>1799257Congress has not declared war since WWII. The constitution is set up so that the President is commander in chief, but only Congress has the power to declare war. But for all kinds of reasons, including the fact that several clauses in laws get activated if a war is declared, Congress doesn't declare war anymore. These days often the president makes the first move, and congress may pass an "authorization to use force". But it's all a work-around. Congress did try to reign in the President after Vietnam, saying the President can use the military for 90 days in an emergency before getting approval of Congress, but even that isn't strictly adhered to the last few years.
So no war has been declared, but that doesn't mean the US hasn't been in any wars since WWII. Government edict does not create reality - a war is a war no matter what the government calls it. Vietnam, the war against Iraq, etc. were all wars.
