Software should always be public domain and anybody that has a binary of the software should be able to get the source code. The person who distributed the binary should either have to distribute the source code gratis in a public place (like a website), distribute the source code and the binary together, or have an offer to give the source code to anyone they distribute the binary to. In the last case, there would be a time limit for the recipient to get the source code that would last 2 years. The time limit is there because it would be extremely cumbersome to make someone keep the source code forever if they distributed binaries.
