Congress has the right to regulate commerce between the states, the argument by the founders was that they didn't want some states teaming up to economically bully other states.
The intent is wonderful, but that's not what happens in reality. Instead, you get asshats who want to control everything, so you wind up with shit like the war on drugs--because of the interstate commerce clause.
The only reason congress can federally place a ban on the sale and possession of goods/services, is because of extremely vague interpretations of that specific clause.
That's what happens when you create a monopoly on authority, and somehow, this specific instance is supposed to be different.
