1. no it could not be considered Rape. Not even in Sweden where they have a really expanded definition for rape (hence their large lead in number of rapes)
2. Her comment was obviously non-sexual. Men don't wear shirts at the beach and women wear something to cover their tits for a reason. Tits are sexual on a woman, and largely nonsexual for men, so her comment shouldn't be construed as sexual harassment.
That said, what a total bitch. Making fun of an overweight person at a gym is really the lowest of the low.
