then it's pretty sketchy to be a closed source emulator since they're only legal if you can prove you're not stealing any of the software from the original machine. when it's open source anyone (especially nintendo) can keep tabs on how the code is developing to ensure it's organic. by hogging the code all to themselves nintendo could sue at any point and the onus is suddenly on the developers to prove they're mimicking and reverse engineering instead of copying. of course it also means that there's a small team of people instead of anybody with interest in this sort of thing being able to contribute.
then there's the patreon thing which means they have incentive to work slowly, pace out updates, or intentionally leave in bugs so that people keep giving them money
so basically it's a whole lot of potential scenarios and hypotheticals, but it's pretty sketchy
