(For **ALL** intents and purposes, the definition of rape used should be "sex without consent", and rape doesn't necessarily imply violence or harm.)
Because the way I honestly see it, not only is consent an illusion and a social construct, but sex without consent isn't even dangerous to society when no actual real physical harm occurs. And if physical harm does occur, the criminal can be prosecuted for that real damage. How come the sex is being prosecuted too just because there's no consent? Furthermore, doesn't it sound entirely artificial, almost a political crime in a totalitarian system just to prosecute somebody because their sex partner said a few times "no" during sex but laid there anyway for whatever subjective reason?
