If that's the case the eurocrates have already find the solution: high power, high speed e-bikes are classified as L1e-B motor vehicles, aka mopes. See the Stroomer for an example
You can ride them with an AM license and a helmet.
A special directive allow members state to allow for a special e-bike helmet instead of the standard motorcycle helmet, the only states where it is applied are the Netherlands and Belgium.
I think it is a really good solution as the moped (motor + pedals) is the vehicle class that was literally created to accommodate bicycles with an auxiliary motor attached. I'll go even further: eurocrates should BAN L1e-B scooters as they are an abomination and leave the L1e-B class only for e-bikes and real mopeds like the Piaggio Ciao.
It is ludicrous to have those 50cc scooters which are basically the same model as the 150cc version and the manufacturer expects you to remove the speed limiters...
