that's fucking insane. The state is basically just saying that what this rider was doing was what got him killed. It's no different, in terms of the accident, from someone who had simply been cycling to work. So basically, if you cycle, you might die, and it's your fault. It's literal victim blaming.
He's got a reasonably bright light. He is visible. The one mistake I think is not having a blinker. I imagine he's running dynamo lights and he should have a battery flashing light as well. That's a BIG mistake.
And I don't think it should be murder or manslaughter. It's an accident. But it should definitely be reckless driving causing death, atleast a year of driving suspension and either a large amount of community service or a large fine.
