that's fucking insane. The state is basically just saying that what this rider was doing was what got him killed. It's no different, in terms of the accident, from someone who had simply been cycling to work. So basically, if you cycle, you might die, and it's your fault. It's literal victim blaming.
He's got a reasonably bright light. He is visible. The one mistake I think is not having a blinker. I imagine he's running dynamo lights and he should have a battery flashing light as well. That's a BIG mistake.
And I don't think it should be murder or manslaughter. It's an accident. But it should definitely be reckless driving causing death, atleast a year of driving suspension and either a large amount of community service or a large fine.

I imagine that if you dropped a chainsaw out of a tree and hit another arborist below then that would also be a tragic accident rather than murder/manslaughter. I can't really think of how else you would accidentally kill someone else with a chainsaw, without behaving in a grossly negligent way.

The negligence is implied but actually it's pretty easy if you don't know what you're doing.
Hitting a hard knot of wood or something metal because like we said, you don't know what you're doing and thought you could just saw into a roofing beam or pole with metal bolts/studs/something, when you hit something hard, the saw can buck up. It's supposed to stop as soon as it leaves the wood like that, you should be holding it so that the safety grip stops you from sawing anything nearby, you shouldn't be sawing with people next to you, all that stuff. But if you're an idiot and hired a chainsaw to cut up some wood scraps or random hardwood for firewood, you could do shit like that and lose control and saw through anyone standing around you.

Nah, pedestrians killed by drivers are a crime. You can't plead 'came out of nowhere' when you truck of peace a crowd. It's a special rule for cyclists.

Nah, Ausfalia definitely isn't the only place it would happen but it's up there for one of the most likely places to let cagers get away with it.
A bunch of US states too but not all of them, I'm sure Eastern Europe isn't that great but lots of places would take it seriously.
Western Europe is probably pretty good, mostly. In China, there's kind of a reverse pecking order, drivers are assumed to be at fault if they hit a cyclist and a cyclist is assumed to be at fault if they hit a pedestrian. I believe Vietnam has a similar thing.

Same in France and most of continental Europe i believe. The UK seems to work more like Australia.

That's pretty fucked up. It's hard to imagine that running a red light doesn't count as knowing that there's a problem with your driving.

In any case, that's homocide that they're talking about, manslaughter is the usual charge. Using a higher level of offense as the measure like that is something prosecutors do when they want to lose a case, or in this case, justify not prosecuting one.

So it's just a chance thing.
Taking a hard punitive step is not going to solve anything and would be punishing a fundamentally good (i assume) person who just got unlucky. They should be prosecuted, but not harshly. Long jail time is just a drain on society which achieves nothing. If they are a good person, the blood on their hands is already a severe punishment.

Instead there needs to be broad action taken to reduce car use, by making it prohibitively expensive and offering quality alternatives, while also taking steps to improve road safety and pedestrian safety. It's really the responsibility of the media more than the state to bring such changes about off the back of these tragedies. These cases are fundamentally social problems not personal criminal ones.

2. Overtake them immediately. checking for oncoming traffic is optional, there's enough room

Well the thing is that if it had been another car, this would not have made the news. It would have been another traffic accident. But because they hit a cyclist instead of another steel cage, the consequences are higher. And of course it's the cyclist's fault for not being in a steel cage.
