I don't think the assumption that you're not guilty is correct. As the driver you are responsible for supervising the autopilot and are legally responsible for any and all consequences of the actions of the autopilot.

Almost, you forget the 'aware' and 'capable' of the opportunity. You can't expect a random citizen to understand computers and AI, so when it gets cleared for auto-pilot the legal end responsbility will likely fall on certification and compliance.
