It's not just bad conduct, if they leave the agency for any reason at all (quit, fired, laid off due to massive downsizing, etc) before the full five years, they have to pay back the pre-tax amount of the heavily taxed bonus they received. Even if they save the entire bonus amount just in case they need to give it back, they'll still be short thousands of dollars because it was given to them in a regular taxed paycheck.
