NEW YORK — Sen. Bob Menendez was charged in a superseding federal indictment Thursday with conspiracy by a public official to act as a foreign agent, intensifying the legal peril the veteran lawmaker faces as he continues to resist calls to resign.

Menendez (D-N.J.); his wife, Nadine Menendez; and an associate, Wael Hana, were charged with conspiring to have Sen. Menendez act as an illegal foreign agent on behalf of the Egyptian government while he was serving as a U.S. senator with access to sensitive intelligence as the former head of the Foreign Relations Committee.

Federal prosecutors charged Menendez and his wife with bribery last month, alleging that they accepted cash and gifts totaling hundreds of thousands of dollars in exchange for assistance to the Egyptian government between 2018 and 2022.

The senator, his wife and three associates — Hana, Fred Daibes and Jose Uribe — were charged with conspiracy to commit bribery and conspiracy to commit honest services fraud in an indictment unsealed Sept. 22. The Menendezes also were charged with conspiracy to commit extortion as a public official.

All the defendants pleaded not guilty to the first indictment.

Menendez, who is of Cuban descent, pushed back against the new charge in a statement touting his record opposing the Egyptian government on key issues, declaring, “I have been, throughout my life, loyal to only one country — the United States of America, the land my family chose to live in democracy and freedom.”

“Piling new charge upon new charge does not make the allegations true,” Menendez said. “... It is an attempt to wear someone down and I will not succumb to this tactic.”

In a statement, attorneys for Nadine Menendez said Thursday that she “denies all the allegations set forth in the superseding indictment, including the claim that she acted as an agent of any foreign government. We will fight all these charges, as appropriate, in court.”

Bob Menendez, 69, who served in the House from 1993 to 2006 before assuming his Senate seat, beat an unrelated federal corruption case in 2017 when a New Jersey jury deadlocked.

According to court documents, in 2020, as Menendez illicitly engaged with Egyptian intermediaries, he urged the Justice Department to investigate a former Congress member on the grounds the ex-official consulted for a state-run Venezuelan oil and gas company without registering as a foreign agent, as required by law.

The former member of Congress who was the subject of Menendez’s inquiries about compliance with the Foreign Agents Registration Act is David Rivera, a Florida Republican who was elected in 2002 and served until 2013. Rivera was indicted in November 2022 on charges he illegally lobbied for Venezuela.

Menendez is not charged with failing to register, but senators are prohibited from working on behalf of another country.

His alleged assistance to Egypt occurred as its relationship with the United States was fraying. Because of human rights and democracy concerns, U.S. military support to Egypt was held up by the State Department.

According to prosecutors, Hana and Nadine Menendez began to broker meetings between Sen. Menendez and Egyptian officials after Egypt’s funding issues began.

The superseding indictment includes a group photograph of Menendez and an unidentified Egyptian official at the senator’s office in Washington in March 2018. About two months later, prosecutors say, Menendez provided sensitive details about the U.S. Embassy in Cairo and its staff to an Egyptian official through Nadine, who was his girlfriend at the time, and Hana.

The U.S. attorney’s office in Manhattan has described Menendez growing increasingly cozy with the Egyptians he was introduced to by Hana and Nadine, whom he married in October 2020.

Menendez was photographed in May 2019 at a dinner with another Egyptian official at a D.C. steakhouse where foreign policy was discussed, according to the new indictment.

The couple and Hana all pleaded not guilty in U.S. District Court in Manhattan after the initial indictment. Menendez also gave up his committee chairmanship temporarily, in accordance with Democratic Senate rules.

The indictment described Menendez accepting gold bars, cash and a Mercedes in exchange for his cooperation with Hana, who was the senator’s U.S.-based go-between with Egyptian officials. The Menendezes also expected Hana, a halal meat distributor who authorities said had a monopoly on Egyptian meat exports, to give Nadine a low- or no-show job in exchange for their assistance, according to the indictment.

Prosecutors said Menendez lobbied to the U.S. Agriculture Department to try to ensure Hana’s status as sole distributor stayed intact. Hana’s arrangement with Egypt raised costs for U.S. halal meat buyers.

Federal prosecutors have said that Menendez also tried to influence the Biden administration’s nomination of a U.S. attorney in New Jersey with the goal of getting a candidate appointed who would be sympathetic to Daibes, a real estate developer who is also facing bank fraud charges in New Jersey.

Since Nadine Menendez’s arrest in the bribery case, her involvement in a fatal 2018 collision with a pedestrian was revealed in a NorthJersey.com report. She was not charged or given a summons in connection with the incident. The New Jersey attorney general is reviewing how the incident was handled by investigators, according to news reports.

New Jersey Gov. Phil Murphy (D) and Sen. Cory Booker (D-N.J.) are among several prominent figures who have said Bob Menendez should resign from the Senate.

Rep. Andy Kim (D-N.J.), a former Pentagon and State Department employee who is campaigning for a Senate seat and plans to challenge Menendez if he seeks reelection, wrote in a social media post on Thursday that the Senate should expel Menendez.

“As a former national security official who swore an oath to defend our Constitution, I cannot stand by as the Senator representing my family and my state has been accused of acting as a foreign agent,” Kim wrote.
