Look up the actual case after that article. Turns out the bathroom meeting was the two of them sneaking off to the bathroom to talk like they had several times prior, at which point the rapist attacked her. There was no shared bathroom, just a girls bathroom no teacher was moderating. The rapist wasn't even wearing a skirt on the day of the attack, and his attack on his first victim was a year before any kind of bathroom trans gender policy was implemented. There was a full investigation into this and part of it was determining that the rapist never identified as anything other than cis, he just wore a kilt/skirt on occasion to stand out.
