This isn't a criminal trial. There is no evidentiary hearing or any kind of evidentiary standard.
The committee could literally make shit up if they wanted. Because this is a political trial, not one which actually matters.

Part and parcel with a member of congress joining the executive branch necessarily requires them to resign their previous position. No single person can hold office in two branches of government at the same time.
