It's written as something called "a preponderance of the evidence" which means they only have to prove it's 50% plus any percent over that equals guilt. Meaning an officers suspicion and word in court already equals the 50% of the guilt needed to be proven. All they have to do is provide any percent over that... even fractions of a percent and you are guilty and your civil forfeiture is justified. I used to live in Illinois and live out west now I recall that kid getting run over and killed by a boater in the chain of lakes/fox lake that was drunk and high on coke that spurred the new enforcement. It's hilarious they think it couldn't happen in texas.
