Am I allowed to go kayaking on the river when its temperature is below freezing? The safety label in it says under no circumstances should you use this kayak in water below freezing

You can do whatever you want, anon. The problem is whether it's safe or not. I'd say go for it if you're pretty experienced on/in the water, aren't going too far from a reliable source of warmth, and you have a proper neoprene wet suit. Make sure you're prepared for what being dunked in subzero feels like too, it's a whole different animal to anything else.

Literally safe to use on any water, because if it is water, then it’s not below freezing

Not all the time. Water with enough movement like rivers can hit below zero and not freeze. Really salty water also doesn't freeze until around -20C.

But they're the same temperature. I just use Celsius because I was raised with it and any system of measurement is completely arbitrary so it doesn't matter.
