The owners never visit their property, so if I get caught it has to be by someone else that's also trespassing since I can't be seen from the road most of the time.
even if a cop did manage to catch me trespassing, it's unlikely the ticket would stand in court since the property may have several owners or be a corporation, the owners may not press charges, even if they do press charges I'll argue that they should prosecute everyone that uses their land, not just detectors, and also that the property is not fenced or posted so they can't expect people to keep out.
so far these various arguments have prevented me from ever getting a trespass conviction or ticket. But that's up to you if you want that risk. To me if it's not posted and other people are using it, I'm going to detect it when I want. If I really like the land I might even pay the taxes on it and take it from the owner via adverse possession.
