Then you could be be able to load the film. Not sure if there other any other interlocks preventing you from advancing to the start of the roll properly, haven't tried that.
It's not convenient at all though.
I think you should ask for a partial refund.
Even though a simple part mechanically, it's an integral part of the camera operation and the camera doesn't function properly without it. And since you most likely won't find a dark slide for less than the price of a full back, €50 refund would be reasonable.
