called up black magic, they said the switch repair would cost literally 40 bucks, and when asked about whether or not it was smart to power down from just pulling the battery/plug, he said he's talked to many a customer who did just that with this same issue for a long time with no problem.
talked to the seller about getting a partial refund for the missing battery and repair cost, and he basically said "yeah sure" and then stopped responding completely. so i called up ebay and told them about it and he has until wednesday to put that refund through or ebay will do it themselves. so all in all, i'd say i lucked out with a sub 800 dollar bmpcc 4k with one issue not related to actually using the camera. totally happy with that. the whole thing just makes me feel like the guy stole it from someone and was just trying to offload it. oh well.
