Bc then no one would have given a shit. It's about marketing. By saying the monkey took the photo he got picked up by the press and became famous. Who knows if the monkey really even took the pic. he probably took it himself.

That would've opened up a can of worms if that happened. Imagine if you used a device to take a photo when it sensed a lightning flash. Could you claim rights over that image if it was the lightning that actually triggered it? You could theoretically boil it down to no photographers own their images because their camera is making it, not them

A photographer on Reddit recently tried something similar with monkeys. I noticed that it was a massively composited image and he got destroyed for it.
That's why this photographer played it safe. It was a clever marketing move.
