Absolutely no diversion available on a third aggrevated assault. He will not be entered into a diversion. He's going to have to hire an attorney, he's going to have to acquire a defense counsel, and they're going to have to look at the applicable motions. If he doesn't fight the case and takes a plea, I guarantee you he will be incarcerated and, more likely than not, placed on death row.
