Because this is his third aggrevated assault, and his firearm permit was actually suspended or revoked from the aggrevated assault, he's looking at guaranteed jail, probably prison time. Absolutely no diversion available on a third aggrevated assault. He will not be entered into a diversion. He's going to have to hire an attorney, he's going to have to acquire a defense counsel, and they're going to have to look at the applicable motions. If he doesn't fight the case and takes a plea, I guarantee you he will be incarcerated and, more likely than not, placed on death row.
