Bro fights aren't like in the movies. Usually when someone put someone else on a choke hold it's broken up and the way it was described Punk wasn't choking Jack as much as trying to incapacitate him and putting him on the ground. I do BJJ after work and that's something we can easily do.

Not only is there precedent for a chokehold being deadly force, Punk escalated the situation to being a physical one even in his own account of it. Combined with Punk's previous incident it would be very difficult, from a legal perspective, to defend this one.

That is how these things play out. If Perry had initiated it and then escalated it, Punk would be good. But Punk choosing to turn it into a physical confrontation and then take it even further is really bad from a legal perspective. You can't attack someone and then go for lethal force when they fight back, imagine if every faggot with a CCW and a chip on their shoulder could escalate like that.
