AEW was able to sign Will because they got NJPW's permission, aka compensated them for it. They are active in the US so US anti-tampering laws apply to them unlike other Japanese companies such as Stardom where NXT blatantly brings them to the PC, even though Stardom is under Bushi as well the rules are different since they don't have a physical branch in USA like NJPW does.

There are no actual anti-tampering laws, it's just a rule that sports leagues/unions agree to. If you induce somebody to breach their contract, though, you can get in trouble for tortious interference. Like if it turned out WWE contacted CM Punk and encouraged him to get in a fight and get fired so that they could hire him, that is something AEW could sue over.

True as in directly under being called tampering by a court but appearing on another company's show and announcing you are going elsewhere and to wait for him is tortious and possibly harmful to NJPW's business until Ospreay is finished his contract, which can be acted on legally, so there is no way AEW would do it. It also would set a huge precedent where WWE could do the same thing with an AEW guy and they couldn't say anything because they did it.
