The NDA was a work. It would have been part of a financial settlement and would have been accompanied by a no compete clause. Instead Tony fired Phil for cause. The only possibility would be w gag order for an ongoing lawsuit. But Tony can’t say “you’re fired for cause effective immediately and your contract is hereby voided, btw please sign this NDA.”
