By the way, someone was mentioning employee vs. independent contractors for a NDA. A NDA can be entered into by any party that signs and agrees to the terms. Example…I’m interviewing with company that has sensitive IP. They ask me to sign NDA…that’s a contract.
In this case, I’m imagining that their initial agreement, engaging Punk as an exclusive contractor, involved some language regarding conduct and payment clauses. They most likely came to an agreement that they’d absolve him of the conduct issues and pay him if he agreed to sign one.
I handle employment law but with a different specialty (technology and emerging industries) so I’d be lying if I said entertainment law was my area, but I’ve seen thousands of these agreements that are way more complicated.
