We dealt with something like that at work where this idiot would be late every single day, sometimes over an hour or two, and would get warnings galore from our similarly dopey management. When they finally started getting serious with him, he argued that everybody comes in late, albeit 5-15 minutes, so policy has to apply to everyone. And he always did his work and 40 hours, so of course they let him off the hook.
Either that or it's a case of "we need you at TV tomorrow, get down here" and they're going to argue it was last minute just to not be used.
