I'm guessing that whatever contract language or NDA is basically void since Tony is going to show the video. It's a pretty big story so you can't have punk not say anything at all or not reference it. But no they aren't "working together". This has been explained over and over, If they were someone would find out. WWE has to disclose pertinent information regarding it's business to investors. The SEC just give a fuck about wrestling or marks or any other shit like that. WWE is a company to them and they must disclose the information.
