In the actual real adult world in a court of law, it could go to either party. It depends on who has the better team of lawyers. Jungle Bitch did say "Do something about it." which can be construed as instigating.
What Punketty did is a bitch move because he was trying to bait Jungle Bitch into throwing the first punch (nobody threw any punches.) but I also don't believe that the law would side with either one just from the filmed evidence. The defense would build a case that led up to that, and in that regard jungle bitch doesn't seem as innocent because his passive aggression can be labeled as harassment.
