He has rights to use the mask, it was set up on the purchase and contracted. What he doesn't have the rights to use and reproduce its likeness for products i.e. shirts, toys etc.
They settled for a new design with the same company with all rights bought, but they didn't change the mask because SOME RETARD in the company the old one was "in the audience mind" already.
So despite turning heel, they kept the same mask design and now are getting sued for it.
