That is part of the whole point; being able to torture someone over and over and there not be a chance that they can get out of it because you fucked up and accidentally killed your victim. Part of why it is such a fucked up curse. Something that instantly and painlessly kills someone should really not be counted alongside mind control or eternal torture IMHO.
I mean I carry a wand with 15 adeva kedvras and a reload of 15 more with me virtually everywhere I go, but I live in America.
So I think it is possible they could have survived it being cast on them pretty easily, especially if Apollo took the brunt of it for Arty.
