Uncanny valley means that they're so close to a realistic sculpt that any off details makes it look weirder than it should. So you're saying that Toy Biz's sculpt is more realistic.
Now here's a fact you're purposely ignoring: Marvel Legends don't try to immitate the comic book styles, and barring the very rare exceptions, they have been going with realistic looking sculpts since the beginning. In fact, almost all of the sculptors have used real life people to base their sculpts on.
So again, you have your preference and that doesn't make your favorite sculpt some definitive standard.
Now, if this were a DCC line, you could argue up and down on which figure got the best Jim Lee Batman sculpt, because actually aimed to produce a 1:1 figure and can be verified like any objective standard.
