Here is the link from the TMNT thread with the screencap showing the relevant passage.
https://www.ftc.gov/business-guidance/resources/business-guide-ftcs-mail-internet-or-telephone-order-merchandise-ruleNow pay attention.
>It is unlawful to:>1. Send any merchandise by any means without the express request of the recipient (unless the merchandise is clearly identified as a gift, free sample, or the like) or,>2. Try to obtain payment for or the return of the unordered merchandise.>Moreover, customers who receive unordered merchandise are legally entitled to treat the merchandise as a giftNECA sent unordered merchandise, as per article 1. It doesn't matter if it was a mistake by NECA. It was sent to the customer without their permission.
It is unlawful for NECA to request that customers return it, as per article 2.
Customers who receive unordered merchandise ARE LEGALLY ENTITLED TO KEEP IT AS A GIFT.
That is the important part.
The thing is, I agree that anyone who decides to keep their duplicate Lab is being a bit dickish and not morally in the right, but the law is on their side, and what NECA have done has shown what an unprofessional operation they are running, and have shown they have no idea how the law operates.
And your attempted defense when you clearly don't know the law is making them look worse. Your attempts to damage control the situation on their behalf when you can't even cite relevant legislation is laughable.
