Disney can use anything they want. They 100% bought it.
They don’t want to piss off Lucas and have him say shit that will cause older fans to stay away from newer stuff. But Lucas never cared about Boba Fett, he thought it was a cool look that fulfilled a minor role and was amused that fans latched onto him. Its why Lucas gave a huge greenlight for everyone to write about Fett, he wasn’t an important character.
Lucas took an interest in Boba after Shadows Of The Empire, which made him want to give the character an origin with Jango Fett. That’s the extent of his interest.
But Disney can’t piss off Lucas with using him. They even put him in as a cameo in the first episode and in a pre-FA novel had Fett survive the Sarlacc with some Tatooine merchants selling some of his gear they found in the desert.
