Best-lock went to trial with LEGO, because they wanted to trademark the 8 stud brick, because the patent was gone...

But they actually copied (actually I believe they pirated) it from Hillary Page toys.

So, as long as you add some Pieces to it, it's not the same as the Trademark, and you're good to go.
