If so you should have grounds for a preplacement part.
He's from the All Stars 3 wave, so they might have some extras left for replacement. At least you have a better chance than anything from before Arethyr wave.
If you're honest about when you got it and how long the problem has been happening; and courteous in your email, I'm sure they'll give you the part.
