As for bootlegging, that's more likely to get you slapped but 1. it costs Hasbro/Takara money to go after them and 2. these companies might be able to rebrand themselves under a different name. The 3P Unicron thing was a different case but it's still going to come out regardless.
There have been cases of third party companies getting fucked, like pic related being cancelled and seized. Bandai also shut down a factory for Gunpla and Saint Seiya KOs too, but of course there are still multiple companies producing them
