What seems to have happened back when Lou Scheimer negotiated terms with Mattel was that Filmation would own TV and film rights in perpetuity while Mattel would own exclusive rights to toys and print media (presumably considered vital for minicomics). Did the contract detail anything more specific than that regarding Hordak, Grizzlor, Leech or Mantenna? Who knows. Neither corporation wanted to use them until 2002-3, when they appeared on the first He-Man cartoon since 1990 and the Filmation library was a dormant set of rights held by Hallmark.
Plus new "boy's toys" kept being introduced on She-Ra after the pilot. Perhaps that original contract stated that any characters in the Masters of the Universe toy line would legally be guest characters like He-Man himself, but they were generally exclusively part of the Etheria setting.
