They won't win. All the other pieces are in public domain though, I believe that even the Animals.
I don't understand why they are completely ignoring the Intelecutal properties though, I have the belief that the animals are sculptures, so they should have been protected by copyrights. But you can find the animals everywhere.

So any minifigures clones would be an trademark infringement. So if you create product it would be like you are distributing LEGO's logos and stuff.
