I know that Marvel Legends hasn't really faced that problem, but they'd prioritize these licensed properties because of how the licenses are written (ie, release movie wave during corresponding month or pay penalty fees AND all royalties that are owed for estimated sales during that time period. OH, and Disney will consider Mattel's bid next time, because Mattel promises they'll sacrifice a thousand babies to please the shipping gods to make sure toys get out in time).
