Batman is a tad bit under 6" tall, so Superman is in scale with 1:12 figures (he's 6'3" in the comics. deathstroke is 6'4")

Later figures have pull down thighs, which allows for swivel motions from the balljoint's cup.

You're thinking of DCC's TAS series, where they changed the plastic to ABS in late 2015 for all their joints. And while i can say that those pre-2015 figures do seem brittle, but from what i saw its from hamhands. The plastic DCC used for their clear plastic is polycarbonate, which is one of the toughest plastics there are, except for ABS and a few others. This is why all my clear jointed pre-2015 figures survived handling by my 10 year old and younger nephews. You really have to push to make the plastic crack.
So nice try lying or just being plain ignorant about how DCC solved every issue with your complaint, if it wasn't a lie, anyway
So yep, a lot of great figures that didn't sell, because of people who only repeated outdated and ignorant info.
