I bought him about two year ago and have had no issues with him other than his karate chop action arm springing up a lot but if you tuck one of his fingers behind his belt it stays in place on the shelf.
The reason he looks like that is because JcPenny is currently re-selling the old Toy Story 3 Spanish buzz that the Disney store used to sell back in 2011 for a very limited time only. One of his buttons sets him off, and he starts talking in Spanish just like Buzz did in Toy Story 3 when the bad toys messed with him.
