And they wanted to protect it under trademark. It's the same thing that Disney is doing with Mickey Mouse, that's why they're using the black/white Mickey everywhere. Mickey is about to go public domain, yet no one will be able to use him because of trademarks.
They could only get the Minifigure trademark. I don't think that was okay, because the minifigures were never used as their own thing from LEGO before, they were pieces of a system... they started to market the minifigures like that with that trademark battle. They won. But I don't think they should've won.
Thankfully they lost the brick trademark. I guess that's why they're not using that system logo with the brick on top of it anymore.
